Introduction & Acceptance

Welcome to Appneist (“we,” “our,” or “us”). These Terms of Service (“Terms”) constitute a legally binding agreement between you and Appneist governing your use of the Appneist mobile application available on iOS and Android platforms and related services (collectively, the “Service”).

By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Service.

You must be at least 18 years old to use our Service. By using Appneist, you represent and warrant that you meet this age requirement.

1. Platform Acknowledgements

1.1 Apple iOS Users

This agreement is between you and Appneist only, not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service.

1.2 Android Users

Your use of the Service must comply with Google Play’s Terms of Service. Google is not responsible for the Service, its content, maintenance, or support.

1.3 License Grant

We grant you a limited, non-transferable, non-exclusive, revocable license to use the Service on devices you own or control, subject to these Terms and the applicable app store’s terms of service.

2. Account Registration & Security

2.1 Account Creation

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your information
Keep your login credentials secure and confidential
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

2.2 Account Rules

One account per person only
No sharing of accounts
No automated account creation
We may suspend or terminate accounts that violate these Terms

3. SUBSCRIPTION TERMS & BILLING

3.1 Subscription Plans

Appneist offers paid subscription plans that provide access to premium features. Current subscription options, pricing, and billing periods are displayed in the app and may include:

Annual subscription plans
Free trial periods for new users (where available)
Additional subscription tiers or features as we expand our Service

Exact pricing, billing periods, and available plans are shown at the time of purchase and may vary by region and promotional offers.

3.2 Auto-Renewal

IMPORTANT: ALL SUBSCRIPTIONS AUTOMATICALLY RENEW UNTIL CANCELED.

Subscriptions automatically renew at the end of each billing period
Your payment method will be charged within 24 hours before the end of the current period
You will be charged the same amount unless we notify you of a price change
Auto-renewal can be turned off at least 24 hours before the current period ends

3.3 Free Trial Terms

Free trial is available to new users only
You will not be charged during the free trial period
Your subscription begins immediately after the free trial ends unless canceled
Cancel anytime during the free trial to avoid charges
Unused free trial days are forfeited upon subscription purchase

3.4 How to Cancel Your Subscription

To avoid charges, you must cancel before your trial ends or renewal date:

For iOS Users:

Open Settings on your iPhone
Tap your name at the top
Tap “Subscriptions”
Select Appneist
Tap “Cancel Subscription”

For Android Users:

Open Google Play Store
Tap Menu → Subscriptions
Select Appneist
Tap “Cancel Subscription”
Follow the instructions

3.5 Payment Processing

iOS: Payments are processed by Apple through your iTunes account
Android: Payments are processed by Google through Google Play
We do not store or have access to your payment card details
All payment issues should be resolved through your app store

3.6 Refund Policy

All sales are final except as required by law
No refunds for partial subscription periods
Refund requests must be made through Apple App Store or Google Play Store
We cannot directly process refunds as payments are handled by the app stores

3.7 Price Changes

We may change subscription prices with 30 days’ advance notice. Price changes will not affect your current subscription period but will apply upon renewal.

4. Permitted Use

You may use Appneist to:

Track your workouts and fitness activities
Monitor your progress and measurements
Access workout templates and training programs
Set and track fitness goals
Use the Service for personal, non-commercial purposes
Share your progress with the Appneist community (where applicable)

5. Prohibited Conduct

You agree NOT to:

Violate any applicable laws or regulations
Use the Service for any illegal or unauthorized purpose
Harass, abuse, or harm other users
Upload viruses, malware, or malicious code
Attempt to gain unauthorized access to our systems
Reverse engineer, decompile, or disassemble the app
Use bots, automation, or scraping tools
Share, sell, or transfer your account
Circumvent subscription requirements
Impersonate others or provide false information
Interfere with or disrupt the Service
Use the Service to infringe intellectual property rights
Resell or commercially redistribute the Service

6. Health & Safety Disclaimer

IMPORTANT: APPNEIST IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

6.1 Medical Consultation Required

You should consult a qualified healthcare professional before starting any exercise program, especially if you:

Have any medical conditions or health concerns
Have heart disease or cardiovascular issues
Have joint problems or previous injuries
Are pregnant or breastfeeding
Take medications that affect exercise
Are over 35 and have been inactive
Have any concerns about your ability to exercise safely

6.2 Assumption of Risk

You acknowledge that physical exercise carries inherent risks. You voluntarily assume all risks of injury, illness, or death that may result from your participation in any activities related to the Service.

7. Intellectual Property Rights

7.1 Our Property

The Service, including all content, features, functionality, design, logos, and trademarks, is owned by Appneist and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7.2 Your Content

You retain ownership of content you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, and distribute your content in connection with the Service.

7.3 Feedback

Any feedback, suggestions, or ideas you provide become our property and may be used without compensation to you.

8. Privacy & Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you consent to our privacy practices.

We comply with applicable data protection laws including GDPR (EU) and applicable Dutch data protection laws. You have rights regarding your personal data, including access, correction, and deletion rights as detailed in our Privacy Policy.

9. DISCLAIMERS OF WARRANTIES

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF INFORMATION
UNINTERRUPTED OR ERROR-FREE SERVICE
SECURITY OR VIRUS-FREE OPERATION

WE DO NOT GUARANTEE THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR ACHIEVE ANY PARTICULAR RESULTS.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPNEIST AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
LOST PROFITS OR REVENUE
LOSS OF DATA OR INFORMATION
BUSINESS INTERRUPTION
PERSONAL INJURY OR PROPERTY DAMAGE
ANY DAMAGES EXCEEDING THE AMOUNT YOU PAID IN THE LAST 12 MONTHS

THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Appneist, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorney’s fees) arising from:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any third-party rights
Your content or information you provide
Your violation of any laws or regulations

12. Third-Party Services & Links

The Service may contain links to third-party websites or services. We are not responsible for:

The content or practices of third parties
Any damages resulting from third-party services
Transactions between you and third parties

Your use of third-party services is at your own risk and subject to their terms.

13. Termination

13.1 Your Right to Terminate

You may delete your account at any time through the app settings or by contacting us. Subscription cancellation must be done through your app store.

13.2 Our Right to Terminate

We may suspend or terminate your account immediately if you:

Violate these Terms
Engage in fraudulent or illegal activity
Harm other users or the Service
Fail to pay subscription fees

13.3 Effect of Termination

Upon termination:

Your access to the Service ends immediately
You remain liable for any outstanding fees
We may delete your data (subject to legal requirements)
Sections that should survive termination will remain in effect

14. Platform-Specific Terms

14.1 Apple App Store Additional Terms

For iOS users:

Apple has no warranty obligations for the app
Apple is not responsible for addressing claims relating to the app
In case of third-party intellectual property claims, Appneist (not Apple) is responsible
Apple and its subsidiaries are third-party beneficiaries of these Terms
You must comply with applicable third-party terms when using the app

14.2 Google Play Store Additional Terms

For Android users:

You must comply with Google Play Terms of Service
Google is a third-party beneficiary regarding our license to you
Google has no obligation to provide support for the app

14.3 Export Control

You represent that you are not:

Located in a country subject to U.S. embargo
On any U.S. government restricted parties list

15. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via:

In-app notification
Email to your registered address
Prominent notice in the app

Continued use after changes means you accept the new Terms. If you disagree, you must stop using the Service.

16. Governing Law & Disputes

16.1 Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

16.2 Dispute Resolution

Any disputes shall be resolved through binding arbitration in the Netherlands, except where prohibited by law. You waive the right to participate in class actions.

16.3 Time Limit

Any claim must be brought within one year after the cause of action arises.

17. Miscellaneous

17.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Appneist.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

17.3 No Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

17.4 Assignment

You may not assign these Terms. We may assign our rights and obligations without restriction.

17.5 Force Majeure

We are not liable for failures due to circumstances beyond our reasonable control.
